The Batteries and Accumulators
(Placing on the market) Regulations 2008

     
 


New Regulations (2006/66/EC) that set the framework for businesses wishing to put batteries on the UK market were published on 26th September 2008.

This applies to manufacturers and importers. If you happen to buy from another UK importer, they will have the responsibilities under the \Batteries and Accumulators Regulation 2008.

The regulations apply to all batteries and accumulators; no matter their type

The requirements include

Materials Prohibitions

Restrictions on the use of Mercury and Cadmium their are some specific exempt appliances and industrial applications in the case of Cadmium.

Labelling

The application of the “Crossed out wheeled bin” and the chemical symbols for Lead Mercury or Cadmium, where appropriate.

Removability of Waste Batteries

Removability of waste batteries from certain appliances, which manufacturers will be required to design in such a way that the waste batteries can be readily removed.
 
If you are the first importer of any batteries/battery-containing equipment you will have the responsibility of ensuring your foreign suppliers mark the batteries correctly and include the correct information with electrical items. By default, anything that is manufactured within the EU or imported into another EU country before being supplied to you should be compliant. Ultimately it is the producer's responsibility to ensure that anything brought into the UK is compliant.
 
If you find that any batteries or equipment are not compliant you will be in breach of the regs if you do sell them after 26th September 08 (doesn't apply to anything you already have available for sale before that date but remains unsold at the deadline).
